No one ever really wants to end up in the emergency room, but over the course of a lifetime, everyone will probably end up finding themselves there at least once. Another thing everyone knows about going to the emergency room is that you’ll probably be there waiting for a few hours. If you are facing a dire situation, hopefully you will be treated as soon as possible, but this isn’t always the case. If you were waiting in the emergency room during time that was crucial to diagnosing and treating your ailment, you may have suffered further damage.
Some of the issues that are commonly misdiagnosed or not diagnosed at all include appendicitis, heart attack, aneurysm, stroke, or ectopic pregnancy. A misdiagnosis of one of these health issues can even result in death. There are tragic stories all the time about someone who goes to the emergency room, gets sent home because ER staff says they’re fine, and then suffers unnecessary additional illness or injury as a result, sometimes even including death. If you are able to demonstrate that the ER doctors and staff breached their duty of care in their treatment, you may have a viable medical malpractice claim for negligence.
When an individual comes in and says that they have been the victim of emergency room negligence, they will oftentimes state at least one of the following problems. These include delayed treatment because the ER was busy, failure to order the correct or necessary tests, misdiagnosis, failure to correctly analyze lab results, and failure to assess medical history when administering medication. For example, if a patient was administered anesthesia but their medical history states that the patient is allergic to anesthesia, it may result in serious health problems or even death.
